Terms of Service

1. This agreement

These Terms of Service are a binding agreement between you and Uneven ("Uneven", "we", "us") covering the Uneven mobile app and the website at unevenapp.com (together, the "Service"). By creating an account or using the Service you accept these terms. If you do not accept them, do not use the Service. Our Privacy Policy explains how we handle your personal data and forms part of this agreement.

2. Eligibility — 18 and over

You may use Uneven only if you are at least 18 years old and legally able to enter into a contract. You may not use the Service if you have previously been removed from it, if you are required to register as a sex offender in any jurisdiction, or if applicable law prohibits you from using it. By using Uneven you represent that all of the above is true. We may remove any account we believe belongs to a minor, without notice.

3. Your account — one per person

• One account per person. Duplicate, secondary and "backup" accounts are not permitted, and neither is creating a new account after we have removed an old one.
• Accurate details. Your name, age and profile content must describe you, honestly.
• Your account is yours alone. You may not sell, rent, share or transfer it, and you may not let anyone else use it.
• Keep your credentials safe. You are responsible for activity on your account. Tell us at support@unevenapp.com if you think someone else has access to it.
• You can leave at any time. See deleting your account.

4. What the service is

Uneven is a dating app with a deliberately asymmetric profile: women's profiles are photographs only; men's profiles are voice and text only, with no photographs. We show you nearby profiles based on an approximate area, record your likes and passes, and open a conversation when two people like each other.

We do not promise matches, messages, replies, dates, relationships, or any particular number of profiles. Discovery depends on who else is nearby and what they do. We may add, change, suspend or remove features, and we may impose reasonable usage limits, in order to run the Service well.

5. Your content and the licence you give us

"Your Content" means everything you put into Uneven: photographs, voice recordings and their transcripts, your opener, prompt answers, facts, name, age, basics, messages, and anything you send us in a report or a support email.

You keep ownership of Your Content. You grant us a limited, non-exclusive, worldwide, royalty-free, revocable licence to host, store, back up, reproduce, transcode, resize, transcribe, transmit and display Your Content solely for the purpose of operating, securing, moderating and providing the Service to you and to the other users the Service is designed to show it to. That licence exists so the app can function; it grants us no right to use Your Content for advertising, marketing, promotion, resale, licensing to third parties, or training third-party models.

The licence ends when you delete the content or your account, except that: (a) copies may persist in encrypted backups for a short period, as described in the Privacy Policy; (b) content you sent to another user remains in their copy of the conversation; and (c) we may retain records required for safety, abuse prevention or legal compliance.

You promise that Your Content is yours to post, that it does not infringe anyone's rights, and that everyone identifiable in it has consented to appear. On her side, the photographs must be of you. On his side, the voice must be your own.

If you believe content on Uneven infringes your copyright, email support@unevenapp.com with enough detail to identify the work and the content complained of, and we will act on it.

6. Prohibited conduct

There is no tolerance for objectionable content or abusive users. You must not:

• Harass anyone. No threats, stalking, hate speech, slurs, intimidation, sexual harassment, unsolicited explicit content, or contacting someone who has made it clear they are done talking to you.
• Impersonate anyone. No pretending to be another person, using someone else's photographs or voice, misrepresenting your age, or operating a fake or automated profile.
• Post illegal or objectionable content. No sexual content involving minors — ever, in any form — no nudity or pornography, no violence, no content promoting self-harm, terrorism or illegal goods.
• Use Uneven commercially. No advertising, promotion, solicitation, recruiting, fundraising, escorting or sex work, multi-level marketing, crypto pitches, or driving users to another platform or paid service.
• Scrape or automate. No bots, crawlers, scripts or bulk collection of profiles, photographs, recordings or messages; no reverse engineering, decompiling, or probing our systems; no circumventing rate limits, moderation, blocks or bans; no using the Service to build a dataset or a competing product.
• Redistribute other people's content. Screenshots, recordings and re-posting of someone else's photographs, voice notes or messages outside Uneven are not permitted.
• Expose other people's private information. No sharing someone's address, workplace, phone number or other identifying details without their consent.
• Interfere with the Service. No malware, no attacks on availability, no attempts to access accounts or data that are not yours.

Report anything that breaks these rules from the profile or the conversation — it is two taps away — or email support@unevenapp.com.

7. Moderation, suspension and termination

Photographs are screened automatically before they become visible, and flagged content is held for human review. Reports are reviewed by a person; we aim to act on reports of objectionable content and abusive behaviour within 24 hours, which may mean removing the content, removing the account, or both.

We may remove content, restrict features, suspend or terminate an account at any time if we reasonably believe these terms have been broken, if it is necessary to protect users or the Service, or if we are required to by law. Where it is appropriate and lawful we will tell you why. If you think we got it wrong, email support@unevenapp.com and a person will look at it again.

Blocking is permanent and symmetric: a blocked user cannot see you, you cannot see them, and they are not told that you blocked them.

You may terminate this agreement at any time by deleting your account. Sections 5(b)–(c), 8, 11, 12, 13 and 14 survive termination.

8. Safety disclaimer

We do not conduct criminal background checks, identity verification or any other screening of our users. Automated photo screening and human review of reports are content moderation, not vetting of people. We do not verify that anyone is who they say they are, and we cannot guarantee the conduct of any user, online or in person.

You are solely responsible for your interactions with other users. Use your judgement, and take the ordinary precautions:

• Meet in a public place the first few times, and stay in public.
• Tell a friend where you are going, who with, and when you expect to be back.
• Arrange your own transport, both ways.
• Do not send money, gift cards or financial details to anyone you have met on the app — no exceptions, no matter the story.
• Keep the conversation in the app until you trust the person; leave any conversation that makes you uncomfortable, and block and report.
• If you are in immediate danger, contact your local emergency services first, then report the profile to us.

9. Payments

Uneven is free to use at launch. There are no subscriptions, no in-app purchases and no paid features, and therefore nothing to refund. If we introduce paid features in future, we will publish the pricing, billing and refund terms before they take effect; purchases made through the App Store or Google Play are additionally subject to that store's own payment and refund rules.

10. App stores and third-party services

You get the app from the Apple App Store or Google Play, and your use of it is also subject to that store's terms. Apple and Google are not parties to this agreement and are not responsible for the Service, its content, or any claim about it. Where the app is obtained from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you; Apple has no obligation to provide support or maintenance for the app.

The Service runs on third-party infrastructure (see the Privacy Policy). We are not responsible for those providers' own services or outages beyond our reasonable control.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranty arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, secure or error-free, that defects will be corrected, or that any user, match, profile or piece of content is genuine, safe or suitable.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits your rights as a consumer where those rights cannot be waived.

12. Limitation of liability

To the fullest extent permitted by law, Uneven and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, goodwill or reputation, arising from or relating to your use of the Service or your interactions with any other user — whether the claim is in contract, tort, statute or otherwise, and even if we have been advised of the possibility.

Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 50. Because the Service is currently free, (a) will usually be zero.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify and hold harmless Uneven and its officers, employees and suppliers from any claim, demand, loss or expense (including reasonable legal fees) arising from your content, your use of the Service, your breach of these terms or of any law, or your interactions with any other user.

14. Governing law and disputes

[Placeholder — to be completed by counsel.] These terms are governed by the laws of [jurisdiction], without regard to its conflict-of-laws rules, and the courts of [venue] have exclusive jurisdiction over any dispute — except that consumers may always bring proceedings in the courts of their country of residence where local law gives them that right, and nothing here deprives a consumer of the protection of mandatory local law. Any arbitration agreement, class-action waiver or jury-trial waiver intended for United States users must be drafted and placed here by counsel; none is in force in this version.

Before starting formal proceedings, please email support@unevenapp.com — most things are faster to fix than to litigate.

15. Changes to these terms

We may update these terms. If a change materially affects your rights we will notify you in the app or by email before it takes effect, and we will update the version number and date at the top of this page. Continuing to use the Service after a change takes effect means you accept the new terms; if you do not, delete your account.
